
WASHINGTON, DC (WUSA)-- Former DC Mayor Marion Barry in an exclusive interview with 9NEWS NOW said his medical condition has been a major distraction, but not enough reason for not filing his 2007 tax returns, even after getting a six month extension.
Federal prosecutors are asking a judge to send Barry to jail claiming his not filing is a violation of his probation. Barry was charged with not filing returns from 1999 through 2004.
Through a plea agreement in 2006, the former Mayor pleaded guilty to one count of not filing a DC return and one count of not filing a federal tax return.
He was given three years probation and now has roughly $3,000 taken from his DC government check each month by the IRS for back taxes and penalties.
Barry confirmed to 9NEWS NOW what associates had first said; he is undergoing dialysis three times a week for four hours each session, and he needs a kidney transplant.
The 72-year-old says a donor, described only as a local woman in her 40s, has been approved. No date has been set for the operation which will take place at Howard University Hospital.
Barry is hoping a federal judge will consider his medical condition and not send him to jail for probation violation. He says he'll file his 2007 and 2008 returns in a day or so.
