ARLINGTON, Va. (WUSA9) -- The dump truck driver charged in connection to a fatal accident that took the life of a mother of three small children appeared in court setting a trial date for June 5th.
The neighborhood, friends and family are still reeling from this terrible accident that happened right across the street from Nottingham Elementary School in the 5900 block of North Little Falls Road on February 24th, 2014.
33-year-ol Marvin Valladares from Manassas walked out of the Arlington County Courthouse Friday facing a misdemeanor charge of failing to pay full time and attention.
The driver faces up to 10 days in jail and a $100 fine.
"There should be more of a penalty than just a misdemeanor. He should do community service so he doesn't forget what happened. I'm sure the guilt he has is horrifying but a misdemeanor doesn't seem like enough," Ellen Allen.
Police say Valladares was driving a commercial dump truck when he hit 39-year-old Jennifer Lawson as she was buckling up one of her three children in her minivan.
Police say the truck driver was not speeding, nor was he texting or talking on a cell phone at the time of the incident.
Today was mainly procedural as Valladares stood with his attorney and an interpreter setting the June trial date.
