GAITHERSBURG, Md. (WUSA) -- Montgomery County Police have arrested a man they say was driving the car that struck two brothers, and killed one of them, in Gaithersburg in December.

Thirty-four-year-old Billie Jay Genies and his brother James R. Genies were struck in the 200 block of W. Diamond Avenue at approximately 1:17 a.m. on December 5, 2012, say police. Billie Jay was pronounced dead at the scene. James survived the collision and toldofficers that they were given a ride by people in a black Honda Civic earlier, say police. According to James Genies, the brothers got out near the Gaitherstowne Plaza at Route 355 and Odendhal Avenue and were walking west on W. Diamond Avenue, when they were struck by a black Honda Civic.He told police that he thought it was the same vehicle.

Police later found the Civic unoccupied a short distance away.

Police now say their investigation revealed that the Genies and the driver of the vehicle had a dispute as they were leaving the car. Police say they believe the driver then drove around the Gaithersburg area looking for the Genies, and when he found them he intentionally struck them. Police believe he fled the scene and ditched the car.

Police have identified the driver as 20-year-old Fernando Josue Valenzuela of Damascus. On Thursday, Valenzuela was charged with one count of first degree murder and one count of attempt first degree murder, say police.

Valenzuela has a bond hearing on Friday afternoon.
