ARLINGTON, Va. (WUSA) - Virginia Delegate Patrick Hope recently posted undercover video of himself buying a handgun without a background check at last month's gun show at the Dulles Expo Center.
Over the past few years, Virginia Tech shooting survivor Colin Goddard has gone undercover at guns shows across the country to show how easy it is to buy high powered firearms without a background check.
And in December, Omar Samaha, whose sister Reema was killed at Tech, did the same thing at a Dale City gun show. He bought a revolver for $450 with no background check.
"Two people can meet on line, go into a parking lot, and just exchange case for the gun. And there's no record the transaction and you're selling to whoever you want," said Samaha.
Background checks use the FBI's data base, to prevent felons, domestic abusers, serious drug abusers, or those deemed dangerous mentally ill. Since Seung Hui Cho (the Virginia Tech shooter) slipped through the cracks, Virginia has beefed up it's policies.
"If somebody fails a background check, the state police and the local police to investigate why there was a failed sale. And last year in Virginia alone, it actually led to 850 arrests," said Samaha.
But still, Virginia, and 32 other states do not require background checks on private sales. A gun owner can have a background check provided anyway. Some licensed gun dealers such as Sharp Shooters in Lorton, Virginia will provide background check for private sales. They do charge $50, and the seller has to transfer the gun to the store before the background check can go through. Background checks usually take five to ten minutes, but can also take a few days.
While some gun sellers might be afraid to support universal background checks, Mike Collins of Sharp Shooters isn't.
"I don't think there's anything wrong with background checks. I don't think most people have a problem with them doing background checks," said Collins, who added that since most gun owners are law abiding citizens, they don't have a problem with background checks. He opposed to all of the other gun control measures proposed by the President.
