
The Manassas man whose toddler daughter died in a hot van is appealing his manslaughter conviction to the U.S Supreme Court. Kevin Kelly was sentenced to one day a year in jail for seven years. The Virginia Court of Appeals upheld his conviction and the state Supreme Court declined to hear his appeal. But Kelly's attorney says he remains convinced his conviction was "cruel and unjust." Prince William County prosecutors says Kelly should take responsibility for his actions. Frances Kelly was just 21 months old when she died after spending seven hours strapped into her car seat on a hot May day in 2002. It was hotter than 100 degrees in the car.
Kelly has said he left the girl in the care of his older children while he did chores and errands. In his petition to the Supreme Court, Kelly contends that the Court of Appeals unfairly held him accountable when he delegated responsibility and assumed his daughter was being taken care of.
