
WASHINGTON, DC (WUSA) -- DC City Councilman Marion Barry no longer faces stalking charges. He's leaving open the possibility of going after U.S. Park Police for arresting him in the first place.
Officer Morales arrested Barry in Anacostia Park Saturday after his former girlfriend Donna Watts Brighthaupt accused him of following her.
"Mr Morales had discretion," Barry said. "He could have done nothing. Instead, he made an inappropriate arrest."
Now that the charges have been dropped, Barry's attorney, Fred Cooke, says it shouldn't affect his client's probation on tax evasion charges.
"He has not re-offended," Cooke says.
Community support for Barry is evident, and so is outrage over a headline in the City Paper, the first to release graphic voice mail messages between Barry and Brighthaupt.
"This is ugly. This is a disgrace," Tisa Mitchell told a reporter from the paper. "They need to leave Marion Barry alone."
Barry may have support, but he's not out of the woods yet.
Some Council members are calling for an investigation into the $60,000 city contract Barry negotiated for Brighthaupt.
"We'll address that at the appropriate time," Barry said.
They left the door open on possible action against U.S. Park Police.
"We're taking it one step at a time," Barry said.
