
WASHINGTON, DC (WUSA) -- Federal Judge Deborah Robinson has refused to grant the prosecution's request that Barry's probation be revoked and that he be incarcerated.
Prosecutor's made the request after he violated his parole by not filing his 2007 tax returns on time. It was the 11th time he failed to file taxes on time.
What the judge did rule is that Barry's probation be extended another 2 years, which will keep him on probation well into 2011.
The former mayor told the court he failed to file his taxes again because of poor health.
Barry still owes nearly $300,000 in back taxes.
