LEESBURG, Va. (AP) -- A judge has rejected a motion to replace the prosecutor in a case against a high school administrator facing child pornography changes.
Ting-Yi Oei of Reston, an assistant principal at Freedom High School, was charged last year with possessing child pornography. He also faces two counts of contributing to the delinquency of a minor.
Oei's attorney, Steven Stone, had requested removing Loudoun County Commonwealth's Attorney James Plowman from the case. Among his arguments, Stone said Plowman overstepped his authority when he told Oei to either resign from his job or face more charges.
But a Fairfax County Circuit Court judge denied the motion last week, saying Plowman didn't display bias in his prosecution.
Schools officials say Oei has been reassigned to a clerical job, not inside a school building.
