'Sex While Speeding' At 85 Miles An Hour Trial Begins In Fairfax County

FAIRFAX COUNTY, Va. (WUSA) -- A most unusual case involving allegations of sex, speeding and alcohol on Interstate 495 (known as the "Beltway") in Virginia is headed to trial.

A Woodbridge man is being sued for allegedly causing a crash under some salacious circumstances.

It's not often that a drunk driving case leads to the following statement from a plaintiff's attorney, in this case, Douglas R. Stevens:

"Having sex at 85 miles per hour while drunk on a freeway is willful and wanton negligence."

But that is at the heart of a lawsuit that will go to trial in Fairfax County on Monday. A 28-year-old cab driver is suing the now convicted drunk driver for damages stemming from a May 2010 accident on the Beltway, near Telegraph Road.

Court records reveal the defendant was returning from his 21st birthday celebration in Baltimore when he was involved in a crash that injured the cab driver.

According to legal documents, the defendant:

--was engaged in sex at the time of the collision

--was allegedly driving the vehicle

--was partially or totally in the backseat of the car

The defendant insists another man was driving at the time of the crash, but he denies that.

The plaintiff is suing for lost wages, pain and suffering and property damage. The trial starts in Fairfax County Circuit Court on Monday.
