WASHINGTON (AP) -- Records show Mayor-elect Vincent Gray's new fire chief has been taking a D.C. tax deduction even though he lives and works full-time in Florida.

WTOP-FM says records show former interim D.C. Fire Chief Kenneth Ellerbe is getting a $67,500 Homestead Tax Credit for his home in Southeast.

Ellerbe is Fire Chief and General Manager of the Sarasota, Fla., County Fire Department. He moved to Florida last year.

Ellerbe says he will not take the tax break on his 2010 taxes.

Ellerbe says he did not know that he, rather than his accountant, was responsible for changing his status.
