A man was shot by officers Saturday night in Northeast, D.C. after police say he pointed an apparent gun at them. The weapon turned out to be BB gun.

Kevin Talley, 34, of Northeast, D.C. remained in critical condition on Sunday as a result of the shooting. Police have charged him with assault on a police officer while armed.

Officers were called to 800 block of 8th Street NE for a report of burglary around 9:30 p.m. When they arrived on the scene, police found and confronted a suspect with a gun.

Police say Talley was ordered to drop the weapon multiple times. Officers fired their weapons after he pointed the weapon at them.

Talley was taken to the hospital in critical condition.

Police say after a closer inspection, the apparent gun was determined to be a BB gun.

The officers involved ere placed on administrative leave and body camera video is being reviewed.
